These Terms & Conditions (“Terms”) govern your access to and use of SoMiFali (the “Platform”), operated by SoMiFali (“we”, “us”, “our”), including the website, listings, accounts, and any related services. By creating an account, posting a listing, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
SoMiFali is an online marketplace that lets private individuals and companies list, discover, and get in touch about vehicles, equipment, homes, and services (for sale, for rent, or offered) across North Macedonia.
We provide the platform that connects buyers and sellers — we are not a party to any sale, rental, or service agreement made between users, we do not own, inspect, or guarantee any listed item, and we do not act as an auctioneer, broker, dealer, or agent for any listing unless expressly stated otherwise.
You must be at least 18 years old and able to form a binding contract to create an account. You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that happens under your account. Tell us immediately if you suspect unauthorized use of your account.
We may suspend or terminate an account that violates these Terms, provides false information, or is used for fraudulent or abusive activity.
When you post a listing, you confirm that: you have the legal right to sell, rent, or offer the item or service; the information, photos, price, and condition described are accurate and not misleading; and the listing does not involve a stolen, counterfeit, illegal, or prohibited item.
You keep ownership of the content you upload (photos, descriptions, and other listing content), but you grant us a non-exclusive, royalty-free license to host, display, reproduce, and distribute that content on the Platform and in related promotional placements, for as long as the listing (or your account) is active, and for the retention period described in our Privacy Policy afterward.
We may remove, edit, unpublish, or decline to publish any listing that we reasonably believe violates these Terms, applicable law, or is otherwise inappropriate for the Platform, without prior notice.
Some actions on the Platform, such as publishing a listing, may carry a fee. Where a fee applies, the amount is shown to you before you pay, and payment is processed by our payment provider, Stripe. We do not store your full card details — Stripe handles payment data directly.
Fees are generally non-refundable once a listing has been published, except where required by applicable consumer-protection law or where we remove a listing due to our own error.
The Platform may let users send booking requests, message each other, and leave reviews about a completed transaction. Any transaction, viewing, rental, or service arrangement you make with another user is solely between you and that user — we recommend verifying identity, documents, and the condition of any vehicle, property, or service in person before committing to anything.
Reviews must reflect an honest, good-faith account of your own experience. We may remove reviews or messages that are defamatory, harassing, fraudulent, or otherwise violate these Terms.

You may delete your account at any time from your account settings. Once you do, your listings are hidden from public view immediately. We keep your account and listing data for 30 days in case you return — signing back in during that window restores your account and any listings that were active when you deleted it. After 30 days, your account, listings, and related data are permanently deleted and cannot be recovered. See our Privacy Policy for details.
The Platform's design, branding, and underlying software are owned by SoMiFali or our licensors and are protected by intellectual property law. Nothing in these Terms grants you any right to use our name, logo, or trademarks without our prior written consent.
We rely on third-party services to operate the Platform, including Google (for sign-in), Stripe (for payments), and cloud infrastructure providers (for hosting, storage, and email). Your use of those services through the Platform is also subject to their own terms.
The Platform is provided “as is” and “as available.” We do not guarantee the accuracy, completeness, or legality of any listing, the identity or reliability of any user, or that any transaction arranged through the Platform will be completed successfully. You use the Platform, and any listing or contact arising from it, at your own risk.
To the fullest extent permitted by applicable law, SoMiFali will not be liable for any indirect, incidental, or consequential damages, or for any loss arising from a transaction, listing, or interaction between users, even if we have been advised of the possibility of such damages.
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you through the Platform. Continued use of the Platform after a change takes effect means you accept the updated Terms.
These Terms are governed by the laws of the Republic of North Macedonia, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the competent courts of North Macedonia, unless applicable consumer-protection law gives you the right to bring a claim elsewhere.
